    In part, the Executive Director is the enforcer of a bad taxicab industry influenced law that does not take into consideration the many nuances of interstate & intrastate trade & commerce.

    Prime example is the 2009 Super Bowl. The law states that it is unlawful for any person to operate a limousine on the public highways of the county without HCPTC licensing. So how will Tampa bring in over 1,000 limos to support the SB? Are Operators going to go through the long arduous process of obtaining the licensing? Will Tampa based Operators physically lease & place under their insurance policies hundreds of limos? Who are going to drive the vehicles? State law requires a Florida Driver's License & Public Vehicle Driver's License issued after a fingerprinted background check.

    It's a double edged law.

    Maybe with a federal challenge to prevent any deviation from the law on the horizon also swayed Cox to pack it in. Could be he was put under political pressure to make promises to NFL transportation demands that he knew violated the provisions of law.

    Amazingly, the newest version of this law was in session when Tampa last hosted the Super Bowl. I was still in NY so no challenge was issued.

    The only thing that can help is getting the right issues before a Federal Judge & having the law declared unconstitutional.

    ECOLUKE has filed a Federal Lawsuit:

    Representing Moshe Leib of TB Limo, Nationally Known Constitutional Attorney & representative of several Florida Intrastate Transportation Alliance Members, Luke Lirot has filed a Federal Lawsuit against the HCPTC over the denial of use of the Hybrid Sedan to provide prearranged/chartered transportation of passengers within the stream of interstate commerce. In part the suit claims that such denial violates the Commerce Clause of the United States Constitution & denies the travelers who desire to use eco-friendly transportation the right to do such.

    I just love it when Dave Shaw, Prez of the West Florida Livery Association & sitting Board Member of the TLPA opens his lips. Yoo Hoo, David, do we know what it means to prohibit someone from offer a particular unique service just to protect another specific business interest? What Act is being violated? Gees, think a Industry Leader would know the law. And what is the big concern of the Tampa Taxi cartel getting upset because other county transportation services are entering Tampa to load their prearranged passengers arriving at the Interstate Hubs?

    It's none of their damn business what type of vehicles are being used or pricing being charged to the travelers!

    According to the commission's rules, limousines must have a "capacity for 15 passengers or less" and adhere to industry norms for luxury. The commission defines luxury by the vehicle's exterior, interior, amenities – TVs, bars and refrigerators – spaciousness and how the vehicle compares to "current industry standards for vehicles performing limousine service in Hillsborough County."

    I guess I don't ask enough questions to my clients, but I do not think they have refrigerators in their stretches.

    But then again, they also run sedans as well.

    Gunny, does the guy have stretches? It said that the name of his company is TB Limo, and I found one online, I just don't know if it is the same one; but they have stretches listed along with sedans, so what is the big deal if the Commission said that he is running a sedan? Thats like a "No shit" kinda statement.
