I think if you filed a lawsuit a judge and/or jury would clean the coachbuilder's clock. However, I also think that any coachbuilder that has not made the car right after the bad press you've given them has not done so because they are not long for this world and will likely be defunct or bankrupt long before your case would go to trial.

I just re-read the grievance thread. My second reaction is that if you picked a lawyer the way you picked a coachbuilder you'll deserve what you get. And if your lawyer doesn't know what the "exact law" is, you better gather up your papers and find a REAL lawyer. After reading the illiterate response of Phil Restivo I can only imagine what the contract you signed looks like. You seem to be doing the right things to document the defects in the workmanship, but get off your ass and find a decent lawyer. In California the laws are such that you should more than cover your damages and attorneys' fees, but I still question whether Phil's company will be viable by the time you get to a jury. Question - is Limelite a separate company from his livery operation? That's a pretty basic question your lawyer should have determined the answer to in the first 15 minutes.
In the meantime, if this is still going on by the time the next Las Vegas show comes up, take the car to Vegas, park it somewhere in front of the hotel or exhibition hall and put big signs on it pointing out the defects and telling anyone who will look who did the conversion. Certainly it will cost him sales, but from my experience in this industry there will still be dumb people lined up to buy cars from him if they're cheap. The average IQ in this industry is about the same as a Chrysler hemi - and I don't mean the displacement, I mean the number of cylinders.

I've been in this business six years, and closely involved for over 10, and, yes, I mean point out the defects. Why do you think Restivo is still building limousines.

JHJ we all agree that this is about as bad a case as it gets, what I can't understand is why the guy isn't in court yet to answer the case, and here's another little thought ( as I checked the ownership of his Limo business ) could the case be brought against Restivo in his own name ( as I assume that he is also listed as owner of Limelite ) in which case it would not matter if he filed chapter 11 on Moonlite as you would still be able to get at him in person ? You could then site his other business interests to show he had gone 11 to avoid paying this guy out.

In the 1980's we viewed many of these cases involving "so-called" backyard builders. That is why the QVM/CVC programs were invented. Frankly, if this happened to me I would e-mail CNN immediately.

Remember the coachbuilder who specialized in first time buyers only ? ( It was said he was an honorary cousin of Mr. Earl Scheib . ) They switched coachbuilders if they survived to the second car AND THIS CASE REMINDS ME OF THAT GUY !
