The Client is reponsible for not breaking the law and company policies, and should be fined for this if there is a no smoking clause in the contract. At the very least, if there is not a no smoking clause, there should be a clause against illegal activities in the car. If so, the run should be terminated immediately with no refund!
It is the Driver's responsibility to monitor what's going on the car, and to put a stop to anything against the law, or company policy.

The real question is, will the Chauffeur do the right thing by the company’s policies? Or will he be more concerned about his tip?

In most states, no, the chauffeur of a limousine would not be arrested for "constructive possession of a controlled substance," which is the legal principle police use to arrest numerous persons in a motor vehicle or closed area, where one or more is found to be in possession of CDS.
A sedan would be a different matter, as it would be clear that the chauffeur knew what was going on.
As was already mentioned, adherence to company policy also an important issue. Also consider the potential liability issues with regard to permitting persons to engage in illegal activities in one of your cars.
Let them smoke pot, and then let one step out of the limo into traffic and get plowed, see if you don't get successfully sued. Your insurance carrier will surely refuse to cover you because you were enganed in, or permitting illegal activity to take place in your vehicle.

Now, a simple question, if the partition is up, how is the driver to know whether or not the client is smoking pot, and can know to end the evening on that. Frankly, the tip should be the least of concerns if there is a need to confront the client on such issues. If the driver thinks the client is smoking pot, rolling down the partition at an "inopportune" moment, might reveal added frustrations if the client is abiding by the laws. You cannot really know for sure unless the driver sees it, or if the clients have exited the vehicle and it smells like it.

Yes Nicole, the tip should be the least of the chauffeur's issues. But......this is the real world. They are not owners. They make their living off tips. I can bet you 75% of the chauffeurs out there would do or say nothing. Specially if you are in California. I understood perfectly what Dave was saying.
I have had to deal with it many times and I think I have been "cool" about it by politely informing people there is absolutely no smoking in the car but I will be happy to locate and park in a descrete area and allow you to exit that car and finish your business. Unlike most siuations, I would remain IN the car while they indulged so if law enforcement drives by, I am clearly in the car and not involved. I am a chauffuer - not a law enforcement officer or the morality police. So, I enforce and advocate - no smoking in the car.

Also, the smell ALWAYS gives it away. I don't care if they open a window, the pot smell still wonders to the front.
I've had it happen and always tell them that they have to put it out or pull over because my boss (me) doesn't smoke and will smell it during the morning inspection and charge you for it. I also tell them that I can't afford to get a contact buzz while driving, it always works and gains respect instead of pissing them off.
Whenever possible I throw the blame to the old boss (me again) so I don't look like the bad guy. This is why "Chris" answers the phone and "Digger" is the chauffeur. I run the company as two different people. http://limos.infopop.cc/groupee_common/emoticons/icon_smile.gif

I actually have bought WATCH YOUR STEP signs for my vans and stretch suvs. Just a liabilty thing.

We have a policy with 4 or more passengers in the car, the divider is ALWAYS in the locked down position for party crouds. Not sure the drivers always inforce this policy. Of course this policy does not apply to corporate groups.
The reason for this policy is so that the driver can properly minitor illegal activity in the back, and to make sure they are not destroying the car. I think that once you exceed 4 in the back, the need for privacy does not exist. If a passenger feels the need for intimate behavior, what's one more in the audience, (the driver).
As far as smoking in the car, the driver can smell it with the divider up or down.

You can crack the front window an inch and any smells from the rear will be pulled up front - this is the discrete way to check. You should have it in the contract that smoking is not allowed and that your company follows all state and federal laws pertaining to the posession and use of tobacco , alcohol and any illegal substance. This is complete coverage of all matters. Also - if you are USDOT compliant - smoking is illegal in limos , sedans , vans , etc.

Boy is this true!!! Gotta share a quick story... I'm driving down the freeway with a birthday party to Monterey, warm summer day, driver window down, divider down, back of car filled with a dozen or so helium ballons and a half-dozen happy partiers. Then, someone decides to roll down both of the rear windows... suddenly a rush of air from the back to the front... FOOM... FOOM... FOOM... FOOM... one ballon after another gets sucked through the divider, across my face, and out my driver window!!!! Scared the living $#!% out of me!!!
I know it has nothing to do with cleints smoking (which is never allowed - no matter what they smoke), but if there is ever any doubt about things being 'pulled up front' this proved it.

I was doing a run a while back in the Hummer which was fully loaded with a really drunk party and the smell of alcohol was very strong. I accidently cut one loose, and figured it would not be detected since the alcohol smell was so strong. WRONG. In a matter of seconds one of the young ladies yelled out you farted to her boyfriend. He said he didn't do it. She said yes you did, you always do, you are so embarassing. Then she started hitting him. She was mad at this poor guy the rest of the night.

I rented out my H2 limo for 12 hours last wed night When it got back it smelled like straight skunk weed. I found a bad of weed that was left behind, i called the customer and he insisted that it was not him, I talked to the driver and he said they were smokin it all night. After you charged the client I would fire the Driver!!! We have rules for a reason. Dont you wonder what eles he lets happen in your vehicles?

Story - once we had 4 passengers in the back of the 20 pass SUV. Driver warned him about smoking weed 3 times. 4th time he pulled the car over to kick the customer out. He didnt want to. He thought he was a smart ass and he can do whatever he wants because he was in jail.
So my driver called the cops to have him thrown out of the car or arrested for possession. Well, of course black cops came in and of defended a customer (ghetto gangster). They didnt mind him smoking weed and he told the driver to keep on going and let him smoke.
CAN YOU BELIEVE at the NYPD. What a scam. !!!!!
How can you let someone go with weed in the car??
Cops were BIAS. Driver should have grabbed his badge number and we would have that cop taken out.
